1. Introduction
GYM VAULT OOD ("GYM VAULT", "we", "us", "our") operates a self-access gym facility and online booking platform located in Plovdiv, Bulgaria. By registering an account, making a booking, or accessing our premises or website, you ("User", "you") agree to be bound by these Terms & Conditions in their entirety. If you do not agree, you must not use our services. These Terms & Conditions constitute a legally binding agreement between you and GYM VAULT OOD, registered under Bulgarian law.
2. Eligibility & Age Requirement
Access to GYM VAULT services and premises is strictly limited to persons who are 18 years of age or older.
- By creating an account or making a booking, you confirm that you are at least 18 years old.
- GYM VAULT reserves the right to request proof of age at any time.
- Accounts found to belong to persons under 18 will be immediately suspended without refund.
- GYM VAULT accepts no liability for any harm arising from underage access obtained through misrepresentation.
3. Reservations & Access
All bookings must be made online through our website. Sessions are available in 30-minute slots, which may be combined into longer continuous sessions. Access to the gym is granted solely via the unique access code issued for your booked slot.
- Bookings are confirmed only upon successful payment.
- Access is available exclusively during your booked time window.
- You are required to arrive on time — sessions begin at the booked start time regardless of late arrival.
- Arriving more than 15 minutes late forfeits the session without refund.
- The gym must be vacated promptly at the end of your booked time to allow the next user access.
- Attempting to access the facility outside your booked time window is a breach of these Terms.
4. Access Code Terms
The access code issued for your session is strictly personal and non-transferable.
- Your code is valid only for the specific date and time slot you booked.
- Do not share your access code with any other person under any circumstances.
- Sharing your code or allowing any other person to use it constitutes a material breach of these Terms and may result in account suspension and charges for any resulting damage or unauthorised use.
- If you have not received your access code, contact us at support@gymvault.bg before your session.
- GYM VAULT is not responsible for sessions missed because a user failed to check their email or contact us in time.
5. Cancellation & Refund Policy
GYM VAULT operates the following cancellation and refund policy in compliance with EU consumer law.
- Full refund: cancellations made at least 24 hours before the booked slot start time are eligible for a full refund.
- No refund: cancellations made less than 24 hours before the slot start time are not eligible for a refund.
- No refund: no-shows, late arrivals forfeiting the session, or early departures are not eligible for a refund.
- GYM VAULT cancellation: if we cancel your booking or the facility is unavailable for any reason attributable to us (including but not limited to smart lock failure, emergency closure, or maintenance), a full refund will be issued within 5 business days.
- EU Cooling-Off Waiver: by completing payment for a booking, you expressly acknowledge and consent that the 14-day right of withdrawal provided under EU Directive 2011/83/EU does not apply to this booking, as the service is scheduled for a specific date and time. This waiver is consistent with Article 16(l) of Directive 2011/83/EU.
- Refunds are processed to the original payment method via Stripe and may take 5–10 business days to appear depending on your bank.
6. User Obligations
By using GYM VAULT, you agree to comply with all of the following obligations. Failure to do so may result in sanctions as described in Section 14.
- Follow all gym rules, safety guidelines, posted notices, and equipment usage instructions at all times.
- Treat all equipment, furniture, and premises with care and not cause any damage.
- Report any damage, defect, or safety concern immediately to support@gymvault.bg or call +359 87 962 1721.
- Pay for all booked sessions in full at the time of booking.
- Maintain accurate and up-to-date account information and keep your login credentials secure.
- Not permit any third party to access the premises during your booked session unless they have their own valid booking.
- Leave the facility in the same condition in which you found it, including re-racking weights and returning equipment to its designated place.
7. Health & Fitness Disclaimer
Physical exercise carries inherent risks. By using our facility, you acknowledge and accept the following.
- You are solely responsible for assessing your own physical fitness and health before engaging in any exercise activity.
- You are advised to consult a qualified medical professional before commencing an exercise programme, particularly if you have any pre-existing medical conditions, cardiovascular conditions, injuries, or have been inactive for a prolonged period.
- You voluntarily accept the inherent risks of physical exercise, including but not limited to muscle soreness, fatigue, strain, and injury arising from activities you freely choose to undertake.
- GYM VAULT is not liable for injury, illness, or adverse health events arising from your own actions, improper use of equipment, or failure to disclose relevant health conditions.
- Nothing in this clause limits GYM VAULT's liability for injury caused by defective equipment, unsafe premises conditions, or our own negligence. GYM VAULT maintains its duty of care to ensure equipment is properly maintained and the facility is safe.
- A first aid kit is available on the premises. In the event of a medical emergency, call 112 immediately.
8. Limitation of Liability
GYM VAULT limits its liability to the maximum extent permitted by applicable Bulgarian and EU law. The following applies.
- We are not liable for loss, theft, or damage to your personal belongings brought onto the premises. Users are advised not to bring valuables. Lockers are provided at your own risk.
- We are not liable for indirect, consequential, or economic loss (including loss of earnings) arising from your use of or inability to use our services.
- We are not liable for injury arising from the inherent risks of physical exercise that you have been warned of and voluntarily assumed under Section 7.
- Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable law. This statement is required by EU law and takes precedence over any other clause in these Terms.
- Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total amount paid by you for the booking(s) directly related to the claim.
9. Property Damage, Theft & Vandalism
Users are fully responsible for any damage to gym equipment, fixtures, fittings, or premises caused by their wilful act, negligence, recklessness, or breach of these Terms.
- GYM VAULT reserves the right to charge the user the full cost of repair or replacement of any damaged or destroyed item.
- In the event of suspected theft of gym property or equipment, GYM VAULT reserves the right to charge the user the full replacement value of the stolen item(s).
- CCTV footage, access logs, and other available evidence will be used to determine liability. By using the facility, you acknowledge and consent to this.
- Any damage or theft claim will be communicated to you in writing (by email to your registered address) with supporting evidence. You have 14 calendar days from receipt to dispute the claim in writing.
- If a dispute is not raised within 14 days, or if a raised dispute is not resolved in your favour, the charge becomes payable immediately.
- Failure to pay a confirmed damage or theft charge may result in account suspension, referral to a debt collection agency, or legal proceedings. GYM VAULT reserves the right to recover all associated costs including reasonable legal fees.
- In cases of deliberate vandalism or theft, GYM VAULT will report the matter to the relevant law enforcement authorities.
10. Smart Lock & Access Failure
GYM VAULT provides keyless access to the facility via the Nuki smart lock system. We are committed to ensuring reliable access for all confirmed bookings.
- If you are unable to access the facility due to a technical failure of the smart lock or access system, you must contact us immediately at support@gymvault.bg or call +359 87 962 1721.
- GYM VAULT will make reasonable efforts to resolve the access issue promptly, including providing an alternative access method where possible.
- If the issue cannot be resolved and you are unable to use your booked session, a full refund will be issued regardless of the standard cancellation policy.
- GYM VAULT is not responsible for access failures caused by user error, including entry of an incorrect code, attempting access outside the booked time window, or loss of internet connectivity on the user's device.
- Nuki's own terms and limitations of liability govern the relationship between GYM VAULT and our hardware provider. These limitations do not transfer to you — GYM VAULT remains fully responsible to you for access failures attributable to our systems.
11. Security & CCTV
CCTV cameras are in continuous operation throughout the premises, including entrance/exit points and the training area, for the safety and security of all users and the protection of our property.
- CCTV footage is retained for a period of 30 days and may be reviewed in connection with security incidents, access disputes, injury investigations, damage or theft claims, or as required by law.
- By entering the premises, you acknowledge and consent to being recorded by CCTV.
- CCTV data is processed in accordance with our Privacy Policy and applicable GDPR requirements.
- GYM VAULT reserves the right to deny entry to or remove any person from the premises who is in breach of these Terms, who poses a risk to safety, or whose behaviour is threatening, aggressive, or disruptive.
12. Prohibited Activities
The following are strictly prohibited on the premises and constitute material breaches of these Terms.
- Aggressive, threatening, abusive, or intimidating behaviour toward any person.
- Use of any prohibited or controlled substance, or attending the facility under the influence of alcohol, drugs, or any substance that impairs judgement or physical control.
- Smoking, vaping, or use of any tobacco or nicotine product on the premises.
- Deliberate damage to equipment, fixtures, furniture, or any part of the premises.
- Theft of any equipment, product, or property belonging to GYM VAULT or other users.
- Sharing your access code or granting access to the facility to any unauthorised person.
- Recording or photographing other users without their explicit consent.
- Any commercial activity including personal training services, promotional filming, or solicitation without prior written authorisation from GYM VAULT.
- Indecent behaviour or conduct that violates public morals and good manners.
- Any activity that is unlawful under Bulgarian or EU law.
13. Account Suspension & Sanctions
Violations of these Terms & Conditions may result in any one or more of the following actions at GYM VAULT's sole discretion.
- Immediate suspension or permanent termination of your account without refund for outstanding credits.
- Denial of future access to the facility.
- A charge for damages, theft, or costs incurred as a result of your breach (see Section 9).
- Referral to a debt recovery agency or initiation of legal proceedings to recover outstanding charges.
- Reporting to relevant law enforcement or regulatory authorities where criminal conduct is suspected.
- The severity of the sanction will be proportionate to the nature of the breach. GYM VAULT reserves the right to take all available legal remedies.
14. Governing Law & Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Bulgaria.
- Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Plovdiv, Bulgaria.
- Nothing in this clause affects your rights as a consumer under mandatory EU consumer protection law, which cannot be excluded by contract.
- Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute in good faith through direct communication within 30 days.
- For out-of-court consumer dispute resolution, you may contact the Commission for Consumer Protection (Комисия за защита на потребителите — КЗП) at www.kzp.bg.
- For online dispute resolution within the EU, you may also use the European Commission's ODR platform at https://ec.europa.eu/consumers/odr.
15. Changes to These Terms
GYM VAULT reserves the right to update or amend these Terms & Conditions at any time. Any changes will be posted on this page with an updated effective date. Where changes are material, we will notify registered users by email. Your continued use of our services after changes take effect constitutes your acceptance of the revised Terms.
